The following are the National Aquarium's Terms of Use. By making a purchase through the National Aquarium website, https://aqua.org, or any other site that links to the National Aquarium's Terms of Use, visiting the National Aquarium, attending a National Aquarium event, or using National Aquarium products or services, you agree to comply with these terms.
Arbitration Agreement
You agree that any dispute, claim, or controversy arising out of or relating to your purchase, these Terms, the use of the National Aquarium's services, or the relationships which result from this agreement, including the validity of this arbitration clause, will be resolved exclusively through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. In this regard, each party waives any right to a trial by jury. Each party to the arbitration shall pay its own fees and expenses, unless otherwise determined by the arbitrator.
The arbitration will be conducted by a single neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA) then in effect. The arbitration shall take place in Baltimore City, Maryland. Any judgment on the arbitration award may be entered in any court having jurisdiction.
BY AGREEING TO ARBITRATION, YOU ARE WAIVING THE RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL FOR ALL CLAIMS.
Class Action Waiver
You expressly waive any right to participate as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. This includes, without limitation, class arbitration, class actions in court, and private attorney general actions.
If a court or arbitrator determines that this Class Action Waiver is unenforceable with respect to any particular claim, then that claim must proceed in court and not in arbitration, and the remainder of this waiver shall still apply to the fullest extent permitted by law.
